Overview
Under the Federal Rules of Civil Procedure (FRCP) all domestic companies must archive its electronic communication (office documents, databases, applications, emails, instant messages, etc) should a law suit require any of these documents to be presented as evidence in a court of law. The recent amendments to the FRCP call for businesses to be alert of, and prepared to, retrieve volumes of information they produce and receive.

According to the FRCP, parties are obliged to provide all such correspondence that would be significant to a case, and they are also required to state their preference and intention on any issues about disclosure or discovery of electronically stored information, including the form or forms in which it should be produced.[1]
